WOW this whole copyright act is highly confusing. My thoughts in the whole Shepard fairey and AP/ Garcia incident is Garcia took the picture he was working for Ap, does this mean Garcia had no say in the picture its all AP that doesn't seem right. I mean if it wasn't for Garcia AP would never of gotten that picture, yeah they would have had a picture of Oboma but not that same one. My idea of the fair trade was that as long as you change the look of the original copyright then you were safe, by far Fairey's picture has resemblance but doesn't look like the original.

ReplyDeleteHere's the deal: Garcia was employed by AP at the time he took that photo, he was on assignment. His contract states the photo and any photos he takes while on assignment are the property of AP. That's the basis for their suite.
